Why act?

The Rome Statute identifies two key factors that justify action by the International Criminal Court (ICC) with regard to the situation in Burma:
1) The SPDC’s commission of the most serious crimes of concern to the international community, including crimes against humanity and war crimes.
The “Crimes in Burma” report identifies four types of abuses that constitute prima facie evidence of crimes against humanity and war crimes committed by the SPDC:
• Forced displacement
• Rape and sexual violence
• Extrajudicial killings and summary executions
• Torture

2) The SPDC’s unwillingness and inability to investigate and prosecute the perpetrators of the widespread and systematic violations.
Lack of independence of the judiciary and lack of institutional capacity have resulted in a culture of impunity surrounding the violations committed by the SPDC
